ADRIC has just finalized Canada’s first national Med-Arb Rules. The Rules Committee met 21 times over the last 11 months to finalize state-of-the-art med-arb rules that are written in plain language. The rules will be posted at adric.ca soon. For a PDF version before then, please contact me.
Med-Arb allows parties to combine mediation and arbitration in a cost-effective process. This permits the parties to negotiate their most beneficial result and to ensure finality for any issues they are unable to resolve through agreement.
My description of the rules during ADRIA’s May 12, 2020 virtual luncheon discussion of the med-arb process, the rules themselves, and the expected Med-Arb designation is available here.
